ScaleMate Terms and Conditions
Version 1.0 | Dated 2 September 2026
Important: These Terms govern access to ScaleMate. Please read these Terms together with the Client Agreement, Risk Disclosure, Privacy Policy and the plan details shown at purchase.
About these Terms
These ScaleMate Terms and Conditions (Terms) form a binding agreement between MarketMates Limited (MarketMates, we, us or our) and the person who purchases or uses a ScaleMate account (you or Trader). By purchasing, activating or trading a ScaleMate account, you confirm that you have read, understood and agreed to these Terms.
If these Terms conflict with the MarketMates Client Agreement on a matter specific to ScaleMate, these Terms apply to that matter. The Client Agreement continues to apply to brokerage, execution, platform, market conduct and other matters not expressly addressed here.
1. Definitions
1.1 Account Equity means the real-time value displayed for the ScaleMate Account, including realised and unrealised profit or loss, and after commissions, swaps, financing, fees and adjustments.
1.2 Available Profit means positive equity above the applicable Reference Balance that we have verified as eligible for withdrawal, after trading costs, prior withdrawals, corrections, reversals, the MarketMates Profit Share and any amounts required for a Level Upgrade.
1.3 Current Level means the ScaleMate level currently assigned to your account.
1.4 Initial Plan means the ScaleMate starting plan selected at purchase.
1.5 Level Upgrade means the progression of a ScaleMate Account from its Current Level to the next level in the applicable Scaling Schedule.
1.6 Maximum Loss means the maximum reduction in Account Equity permitted for the Current Level, normally 10% of its Reference Balance unless a different amount was clearly disclosed at purchase or in the dashboard.
1.7 Profit Share means 80% to you and 20% to MarketMates, unless a different split is stated for your plan before purchase.
1.8 Purchase Fee means the non-refundable fee paid to obtain and activate a ScaleMate Account. The Purchase Fee may also be described on a website, landing page, advertisement, portal or help-desk page as a deposit, risk deposit, risk capital, contribution or similar term. Regardless of the label used, it is legally treated under these Terms as the Purchase Fee. It is not client money, a deposit into a personal trading account, an investment held for you or a withdrawable balance.
1.9 Reference Balance means the nominal account balance assigned to the Current Level for calculating the Profit Target, Maximum Loss and Stop-Out Level.
1.10 ScaleMate Account means the live trading account made available under the ScaleMate program.
1.11 Stop-Out Level means the minimum Account Equity permitted for the Current Level, calculated as the Reference Balance minus the Maximum Loss, or another amount expressly shown in the dashboard.
1.12 Trading day means a day where at least one trade was placed on the day.
2. Nature of ScaleMate
2.1 ScaleMate is an instant-funded trading program. It is not a prop-trading challenge and there is no simulated evaluation to pass before trading begins.
2.2 MarketMates assigns a live ScaleMate Account and makes additional firm capital or buying power available for trading. MarketMates owns and controls all firm capital, the trading account and the infrastructure used to provide ScaleMate.
2.3 The balance displayed in the ScaleMate Account is not money owned by you and cannot be withdrawn. Your only payment entitlement is your share of Available Profit under these Terms.
2.4 ScaleMate does not create a partnership, employment relationship, fiduciary relationship, managed investment, loan, deposit-taking arrangement or ownership interest in MarketMates or its assets.
2.5 MarketMates may hedge, offset, aggregate, internalise or otherwise manage exposure arising from ScaleMate trading in accordance with its execution and risk-management arrangements.
3. Eligibility and Account Approval
3.1 You must be at least 18 years old, have legal capacity to enter these Terms, reside in an eligible jurisdiction and successfully complete any identity, sanctions, source-of-funds or other verification we require.
3.2 ScaleMate is not available where prohibited by law or where MarketMates does not offer the relevant brokerage service. ScaleMate is not available to residents of the United States. Australian residents may apply, subject to eligibility, applicable law and the services made available by MarketMates.
3.3 ScaleMate Accounts are personal and may not be transferred, sold, shared or operated for another person. You must keep your credentials secure and are responsible for all activity conducted through your account.
3.4 The number, aggregate Reference Balance and combination of ScaleMate Accounts you may hold are subject to our approval. We may refuse, cap, aggregate, pause or require consolidation of accounts based on legal, compliance, credit, operational or market-risk considerations.
4. Purchase Fee and Activation
4.1 You must pay the Purchase Fee shown at checkout. The checkout or marketing page may refer to this amount as a deposit, risk deposit, risk capital, contribution or similar term. Those descriptions explain how the amount determines your initial Maximum Loss; they do not change its legal treatment as a Purchase Fee or give you ownership of the Reference Balance or any firm capital.
4.2 The Purchase Fee is non-refundable from the time it is paid, including before the ScaleMate Account is activated or trading begins, except where a refund is required by applicable law.
4.3 We may delay activation while completing payment, identity, fraud, sanctions, technical or eligibility checks. A delay, failed eligibility check or decision not to activate does not create a right to a refund except where required by applicable law.
4.4 Chargebacks, payment reversals, third-party payments or fraudulent payment activity may result in suspension or termination and recovery of amounts owed to us.
5. ScaleMate Plan Schedule
The standard starting plans are shown below. The plan displayed and accepted at checkout governs if the product schedule changes for future purchases.
| Purchase fee / deposit | Level 1 balance | Initial max loss | Initial stop-out | Profit share | Maximum balance |
|---|---|---|---|---|---|
| USD 500 | USD 5,000 | USD 500 | USD 4,500 | 80% | USD 50,000 |
| USD 1,000 | USD 10,000 | USD 1,000 | USD 9,000 | 80% | USD 100,000 |
| USD 2,000 | USD 20,000 | USD 2,000 | USD 18,000 | 80% | USD 200,000 |
| USD 3,000 | USD 30,000 | USD 3,000 | USD 27,000 | 80% | USD 300,000 |
| USD 5,000 | USD 50,000 | USD 5,000 | USD 45,000 | 80% | USD 500,000 |
6. Maximum Loss and Stop-Out
6.1 The standard Maximum Loss is 10% of the Reference Balance for the Current Level. For example, a USD 10,000 Reference Balance has a USD 1,000 Maximum Loss and a USD 9,000 Stop-Out Level.
6.2 The applicable Reference Balance, Maximum Loss and Stop-Out Level will be displayed in the portal or trading platform. You must monitor Account Equity and maintain sufficient margin at all times.
6.3 If Account Equity reaches or falls below the Stop-Out Level at any time, including through unrealised loss, trading costs, slippage or a market gap, we may close open positions immediately and terminate the ScaleMate Account.
6.4 There is no separate daily drawdown limit. The Stop-Out Level applies continuously.
6.5 Under normal market conditions, your ordinary trading loss exposure under ScaleMate is limited to the Purchase Fee and any retained profits at risk. Market gaps, disrupted markets or limited liquidity may cause execution below the Stop-Out Level, but you will not be required to repay ordinary trading losses on firm capital. This protection does not apply to fraud, unlawful conduct, chargebacks, deliberate platform abuse or other liabilities owed under these Terms.
7. Trading Rules
7.1 ScaleMate is intended to operate like a normal trading account. There is no consistency rule, fixed maximum risk-per-trade rule, mandatory stop-loss rule, minimum holding period, maximum number of positions or separate daily drawdown rule.
7.2 Subject to market hours and platform availability, you may scalp, hold positions overnight or over weekends, trade around news events, hedge within your account, scale into or out of positions, and use discretionary or automated strategies.
7.3 Expert Advisors, APIs, copy-trading tools and automated systems are permitted where supported or approved by MarketMates. You must be authorised to use them and remain responsible for every order and all resulting losses.
7.4 Normal trading permission does not override margin requirements, instrument specifications, leverage limits, market closures, corporate actions, sanctions controls or any restriction reasonably imposed to protect market integrity, legal compliance or platform stability.
8. Prohibited Conduct
8.1 You must not engage in fraud, identity misrepresentation, unauthorised account sharing, money laundering, sanctions evasion, market manipulation or any unlawful activity.
8.2 You must not exploit stale or incorrect prices, latency, data-feed discrepancies, execution errors, system faults, rollover defects or other technical weaknesses where the activity is directed at the weakness rather than legitimate market movement.
8.3 You must not use quote stuffing, order flooding, denial-of-service behaviour, emulators, unauthorised scraping or any method that degrades or interferes with our systems or those of a platform or liquidity provider.
8.4 You must not coordinate, mirror, reverse or hedge trades across accounts held by different persons, or use multiple accounts or identities, for the purpose of creating a risk-free or manipulated result, circumventing the Stop-Out Level, obtaining duplicate benefits or misleading MarketMates about beneficial ownership or risk.
8.5 MarketMates will not treat a strategy as prohibited merely because it involves scalping, news trading, martingale, grid trading, averaging, hedging or a concentrated position. The conduct must involve illegality, deception, platform abuse, manipulation or another express breach of these Terms to be prohibited.
9. Trading Conditions and Execution
9.1 ScaleMate provides access to live markets through the trading platforms and instruments made available by MarketMates. Leverage is up to 50:1 and varies by instrument, account, market conditions and risk settings.
9.2 Spreads, commissions, swaps, financing, conversion charges, margin requirements, trading hours and contract specifications apply as shown in the platform or applicable fee schedule. These reduce Account Equity and Available Profit.
9.3 Orders are subject to liquidity, slippage, rejection, delay, partial fill, price gaps and market disruption. Stop-loss, stop-out and pending-order prices are not guaranteed execution prices.
9.4 We may change leverage, margin, instrument availability, trading hours or exposure limits where reasonably required for market, liquidity, operational, regulatory or counterparty risk. Where practical, we will provide notice of material changes.
9.5 Manifest pricing or execution errors may be corrected. Profits or losses directly arising from an obvious error, system fault, invalid price or abusive trade may be reversed after investigation.
10. Profits and Withdrawals
10.1 You may request withdrawal of any Available Profit at any time, up to once per calendar day.
10.2 You may request a full or partial withdrawal of Available Profit. There is no requirement to withdraw all Available Profit unless you are completing a Level Upgrade under clause 11.
10.3 The standard Profit Share is 80% to you and 20% to MarketMates. The Profit Share is calculated on net profit after commissions, swaps, financing, corrections, prior withdrawals and other applicable trading charges.
10.4 Withdrawal requests must be made through the designated portal. Payment is subject to successful identity verification, account ownership checks, sanctions screening, fraud review and confirmation that the relevant profit resulted from valid trading.
10.5 Valid withdrawal requests are typically processed within one business day. This is an indicative processing period rather than a guarantee and may be extended by compliance checks, payment-provider processing, market holidays or investigation of a manifest trading or platform error. We will not unreasonably withhold a valid withdrawal.
10.6 A withdrawal reduces Account Equity towards the Reference Balance and reduces progress towards a Level Upgrade. It does not change the Reference Balance, Maximum Loss or Stop-Out Level for the Current Level. You may not withdraw an amount that would reduce Account Equity below the Reference Balance or otherwise breach the Stop-Out Level.
10.7 Withdrawals will normally be returned to an account or payment method in your verified legal name. Third-party payouts are not permitted.
11. Scaling
11.1 Scaling is optional. You may remain at the same level indefinitely and withdraw Available Profit instead of upgrading.
11.2 The standard Profit Target for each Level Upgrade is 10% of the original Level 1 Reference Balance for the Initial Plan. For example, the Profit Target for a plan beginning at USD 10,000 is USD 1,000 at each level.
11.3 You must remain at the Current Level for at least 15 trading days before requesting the next Level Upgrade.
11.4 Only one Level Upgrade may be completed in a calendar day. Levels cannot be skipped.
11.5 Before an upgrade, all Available Profit above the required Profit Target must be withdrawn. The amount required for the upgrade becomes part of the increased risk allocation at the next level and will not also be available for withdrawal.
11.6 After approval, we will assign the next Reference Balance and display the new Maximum Loss and Stop-Out Level. The Maximum Loss at every level is 10% of that level’s Reference Balance. The Profit Target applied during the upgrade forms part of the increased Maximum Loss and risk allocation provided at the new level.
11.7 A Level Upgrade is subject to verification of trading records, account status and compliance with these Terms. We may correct calculation errors but will not refuse an otherwise valid upgrade solely because of trading style or profit concentration.
12. Standard Scaling Schedule
Each plan progresses in ten levels. The Reference Balance increases by the original Level 1 Reference Balance at each level.
| Level | USD 5k plan | USD 10k plan | USD 20k plan | USD 30k plan | USD 50k plan |
|---|---|---|---|---|---|
| 1 | $5,000 | $10,000 | $20,000 | $30,000 | $50,000 |
| 2 | $10,000 | $20,000 | $40,000 | $60,000 | $100,000 |
| 3 | $15,000 | $30,000 | $60,000 | $90,000 | $150,000 |
| 4 | $20,000 | $40,000 | $80,000 | $120,000 | $200,000 |
| 5 | $25,000 | $50,000 | $100,000 | $150,000 | $250,000 |
| 6 | $30,000 | $60,000 | $120,000 | $180,000 | $300,000 |
| 7 | $35,000 | $70,000 | $140,000 | $210,000 | $350,000 |
| 8 | $40,000 | $80,000 | $160,000 | $240,000 | $400,000 |
| 9 | $45,000 | $90,000 | $180,000 | $270,000 | $450,000 |
| 10 | $50,000 | $100,000 | $200,000 | $300,000 | $500,000 |
13. Suspension and Termination
13.1 A ScaleMate Account terminates automatically when Account Equity reaches or falls below the Stop-Out Level.
13.2 We may suspend, restrict or terminate an account for breach of these Terms, failed verification, fraud concerns, unlawful conduct, abusive trading, payment reversal, platform risk, sanctions exposure, insolvency, or where we are required to do so by law, a regulator, platform provider or counterparty.
13.3 Where practicable, we will investigate and provide the reason for a suspension or termination. Immediate action may be taken where necessary to protect clients, markets, systems or legal compliance.
13.4 On termination, open positions may be closed, access disabled and Available Profit determined after all trades, charges, corrections and investigations are complete. Valid Available Profit remains subject to the Profit Share and these Terms. No profit is payable where it results from fraud, unlawful activity or prohibited conduct.
13.5 The Purchase Fee is not refunded following a Stop-Out or termination after activation, except where required by law.
13.6 You may apply to purchase another ScaleMate Account after a Stop-Out. Approval is not automatic and remains subject to our risk and eligibility requirements.
14. Inactivity, Outages and Account Administration
14.1 There is no inactivity period for a ScaleMate Account. You may leave the account inactive or remain at the same level indefinitely, subject to these Terms.
14.2 You must promptly report suspected platform outages, incorrect prices, unauthorised access or execution issues through the MarketMates Help Desk and avoid knowingly trading on an obvious error.
14.3 We may migrate an account between supported platforms, servers or account groups where reasonably required. We will use reasonable efforts to preserve the economic position of the account and provide notice where practicable.
15. Risk Acknowledgements
15.1 Leveraged foreign exchange and CFD trading is highly risky and may not be suitable for you. Leverage magnifies gains and losses, markets can gap, and you may lose the full economic value of the Purchase Fee and any retained profits.
15.2 Historical results, examples, calculators, targets and scaling illustrations are not forecasts or guarantees. There is no guarantee that you will earn a profit, qualify to scale or recover the Purchase Fee.
15.3 MarketMates provides execution-only services unless expressly agreed otherwise. General information, education, tools or support do not take into account your objectives, financial situation or needs and are not personal financial advice.
16. Privacy, Records and Monitoring
16.1 We may collect and analyse identity, device, payment, platform and trading data to provide ScaleMate, manage risk, detect abuse, comply with law and improve our services, in accordance with our Privacy Policy.
16.2 Our platform, server and transaction records are evidence of account activity unless shown to be manifestly incorrect. We may retain records for the period required by law and our compliance policies.
16.3 We may share necessary information with regulators, law enforcement, verification providers, payment providers, platform providers, liquidity providers, professional advisers and group companies where permitted or required by law.
17. Liability
17.1 Nothing in these Terms excludes liability that cannot lawfully be excluded.
17.2 Subject to clause 17.1, MarketMates is not liable for indirect, consequential or special loss, loss of opportunity, loss of anticipated profit, third-party system failure, internet or device failure, market closure, price gap, liquidity event or event beyond our reasonable control.
17.3 Subject to clause 17.1, our aggregate liability arising from a ScaleMate Account is limited to the Purchase Fee paid for that account plus any verified Available Profit then due to you.
17.4 You are liable for loss caused by your fraud, wilful misconduct, unlawful conduct, chargeback, breach of intellectual property rights or deliberate interference with our systems.
18. Complaints and Disputes
18.1 You should first submit any complaint through the MarketMates Help Desk with the relevant account number, trade details and supporting information. We will investigate under our complaints procedure.
18.2 These Terms are governed by the laws of the Republic of Mauritius. Subject to any mandatory right that applies to you, the courts of Mauritius have exclusive jurisdiction over disputes arising from these Terms.
19. Changes to ScaleMate and these Terms
19.1 We may amend these Terms for legal, regulatory, risk, operational, product or commercial reasons. Material changes affecting an active account will be notified through the website, portal or email before they take effect where reasonably practicable.
19.2 Changes to prices, plan sizes or scaling schedules ordinarily apply to new purchases only. We will not retrospectively reduce verified Available Profit.
19.3 If you do not accept a material change to an active account, you may stop trading and request withdrawal of Available Profit before the change takes effect, subject to these Terms.
20. General
20.1 If any provision is invalid or unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions continue in effect.
20.2 A delay in enforcing a right is not a waiver. A waiver must be in writing.
20.3 You may not assign or transfer your rights under these Terms. We may assign or transfer our rights and obligations to a regulated affiliate or successor by giving reasonable notice.
20.4 These Terms, the accepted plan details, Client Agreement, Risk Disclosure and incorporated policies form the entire agreement concerning ScaleMate.
20.5 Headings assist navigation only. Words such as including do not limit the general words that precede them.
